In the year 2005 New Mexico (NM) introduced new real estate laws and rules which made it difficult for buyers and sellers to protect their interests on their own.

This created a need for professionals who could act as a representative and advocate for the specific interests of the home buyers and sellers. One who offered fair negotiations and protection of individual interest in an unbiased manner.

Seller’s Agents

The Seller’s agents are the representatives of the seller’s interests. These agents are bound by law to get the seller the best terms and price for the home or property.

The Seller’s Agent is the traditional agent who has the seller’s interests in priority. The seller’s agent or the traditional real estate agents have a dual advantage as they make a double profit. The broker makes a profit when the buyer buys a home or property on their listing. This however, makes the loyalty divided. The services offered by the company are also limited in such case. They may be classified as Transaction brokers and Designated brokers. This is done to ensure that twice the profit that is made by the Company is safeguarded. The State Law requires that the Company services are reduced but this does not mean a decrease in the fees charged by the Company. The Company stands to gain in every way.

The Designated brokers are generally part time brokers as they at times work on behalf of the seller and otherwise for the buyer. The Company broker identifies a “Buyer’s Agent” and a “Seller’s Agent” from the company. This results in the loyalty being divided. The role of the company broker however, remains unbiased and neutral in such a case.
